Waiver
Greater Houston Pickleball (“GHP”) RELEASE of LIABILITY, WAIVER of CLAIMS, ASSUMPTION of RISKS AGREEMENT (“Waiver”)
In consideration of being permitted to participate in any way and on any date in GHP activities or events, I, for myself, (together with any heir, successor, representative or assign, collectively as “Participant”), do hereby release, waive, discharge and covenant not to hold anyone associated with organizing the events responsible for any illness or injury Participant may sustain while playing or attending the events.
ASSUMPTION OF RISK. PARTICIPANT AGREES THAT PARTICIPANT DERIVES A MATERIAL BENEFIT FROM THE EVENT AND/OR PARTICIPANT’S INVOLVEMENT THEREIN. BY EXECUTION OF THIS AGREEMENT, PARTICIPANT AGREES AND ACKNOWLEDGES THAT THE EVENT MAY INVOLVE STRENOUS ACIVITY, WHICH MAY BE POTENTIALLY HAZARDOUS, AND PARTICIPANT HEREBY ASSUMES ALL RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING, WITHOUT LIMITATION, FALLS, CONTACT WITH OTHER PARTICIPANTS, THE EFFECTS OF WEATHER AND THE CONDITION OF SURFACES. FURTHERMORE, PARTICIAPNT EXPRESSLY AND UNCONDITIONALLY ASSUMES ALL RISKS AND DANGERS KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, AND RELATING OR INCIDENTAL TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ANY ACTIVITY ASSOCIATED THEREWITH. PARTICIPANT HEREBY RELEASES, FOREVER DISCHARGES AND HOLDS HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS AND EXPENSES, INCLUDING, BUT NOT LIMITED TO, DEATH, BODILY INJURY OR PROPERTY DAMAGE OF ANY KIND OR NATURE (COLLECTIVELY, THE “LOSSES”), ARISING OUT OF OR RELATING TO PARTICIPANT’S INVOLVEMENT IN THE EVENT AND ALL ACTIVITIES ASSOCIATED THEREWITH, INCLUDING LOSSES CAUSED BY THE NEGLIGENCE, OR ALLEGED NEGLIGENCE, OF THE RELEASED PARTIES.
Participant understands and agrees that the GHP BOARD OF DIRECTORS, or any parties associated with organizing, teaching or playing in any GHP event (“Beneficiaries”) assumes no responsibility for injury or illness Participant may sustain as a result of Participant’s physical condition or participation in any of the events. Participant recognizes that it is Participant’s personal responsibility to learn, prepare, understand, and obey the rules for this activity or event.
Participant understands the responsibility to provide Participant’s own Accident and Health coverage and that organizing members of the GHP Events do not provide any accident or health insurance for participants or volunteers.
MEDICAL ATTENTION. Participant agrees that during the Event, the Released Parties are authorized to secure appropriate medical attention for Participant in the event of an accident, illness, or injury. Participant shall be responsible for any and all costs of medical coverage and treatment provided not covered by Participant’s insurance.
Being of legal age of 18 years or older, Participant recognizes that by checking the box associated to this online form; Participant is waiving certain legal rights, including the right to sue. The undersigned expressly agrees that foregoing Waiver and Release of all claims is intended to be as broad and inclusive as is permitted by the laws of Texas and that if any portion thereof is held invalid it is agreed that the balance shall not withstanding, continue in full legal force and effect.
Participant hereby agrees to defend, indemnify, and hold harmless the Beneficiaries from and against any loss, claims, complaints, injuries, or damages incurred by Participant as a result of participation in GHP activities. THE FOREGOING RELEASE AND INDEMNITY IS INTENDED TO INCLUDE CLAIMS ARISING OUT OF THE ALLEGED NEGLIGENCE OF THE BENEFICIARIES.
